The terms on which Abili UG (haftungsbeschränkt) provides the Abili app and the services ordered through it.

Who you are contracting with

The service is provided by Abili UG (haftungsbeschränkt), Postfach 12 19, 82184 Gröbenzell, Deutschland, registered at Amtsgericht München under HRB 260437.

Your account

You need an account to place an order. You are responsible for keeping your sign-in credentials confidential and for what happens under your account. Tell us promptly at info@abili.de if you believe someone else has gained access to it.

The details you provide must be accurate. Orders are executed against the telephone number you enter, so an incorrect number can result in a delivery that cannot be reversed.

Orders

What you buy is mobile airtime credit, delivered to a telephone number you specify on a network in the destination country.

Prices shown in the app are the prices that apply at the moment the order is created, including applicable taxes. Any exchange rate shown is the rate we apply, which is not an official or interbank rate. Placing an order is an offer to buy; a contract comes into effect when we confirm the order, or when we carry out the top-up after identifying your payment.

Before confirming, please check the recipient number and the amount. Once an order has been executed against a recipient number it generally cannot be recalled.

Payment

Bank transfer is currently the only payment method. The app shows the bank details and a GiroCode (EPC QR code) that European banking apps can read; you make the transfer in your own bank. We take no card details and hold no payment instrument of yours.

An order is carried out once we have identified your payment, which depends on when your bank sends it and on banking days. You can upload proof of the transfer in the app to help us match it faster; uploading proof does not by itself mark an order as paid.

Discount codes apply only when the conditions attached to them are met. Their validity and the resulting price are determined by our systems at the time of the order.

Cancellation and refunds

As a consumer you have a statutory right of withdrawal of fourteen days (Widerrufsrecht). Where you withdraw before the top-up has been carried out, nothing is charged and anything already paid is refunded in full.

Once credit has been delivered to the recipient's number it can frequently no longer be reversed, because the delivery happens on a network we do not control. That is a technical limitation, and it does not remove rights the law gives you. So contact info@abili.de as soon as possible and we will stop an order wherever it is still possible to stop it. Availability

We aim to keep the service available, but we do not guarantee uninterrupted operation. Maintenance, network failures and issues at the operators we route through can interrupt it.

Closing your account

You can ask us to close your account at any time, from the account deletion page or from inside the app. Closing an account does not cancel an order that has already been carried out, and does not affect records we are required to retain.

Using the app

Do not use the app to break the law, to interfere with the service or its security, or to access accounts or data that are not yours. We may suspend an account where there is good reason to believe it is being used that way.

Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only where an obligation essential to the purpose of the contract is breached, and then only for foreseeable damage typical of this kind of contract. Liability under the German Product Liability Act is unaffected.

Changes to these terms

We will notify you in the app before a material change takes effect. Continuing to use the service after that point means the updated terms apply to new orders.

Governing law

German law applies. Where you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings at the court your place of residence assigns you. Where the customer is a merchant or a legal person, the place of jurisdiction is Munich.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
